1. GENERAL PROVISIONS
1.1. PsyHelp is an international online information service (hereinafter referred to as the Platform/Website) for finding psychologists and other specialists.
1.2. This Agreement regulates the proper, comfortable, lawful and safe use of the resource under the conditions set out below.
These Rules constitute an Agreement on the terms of use of the Platform by users.
1.3. The User (Client) accepts the terms of this Agreement by using the Platform. By using the online service, including viewing, searching for information, accessing services (hereinafter referred to as using the Site), the user confirms their agreement with the Agreement and all its amendments. If the User disagrees with the terms of the Agreement, the User must immediately stop using the Site.
1.4. The Site Administration reserves the right to make changes to the Agreement at any time without prior notice.
2. TERMINOLOGY
2.1. PsyHelp Platform - an internet site (Platform / Marketplace / Online service) located at www.psyhelp.top, which hosts information about psychology and related fields. Also, the Platform is a tool for searching for Psychologists and their potential Clients for their subsequent interaction. The Platform provides an opportunity for counseling psychologists to post information about themselves and their services, based on which the Client can make a decision about the optimal choice of a Specialist.
2.2. Consultant/Specialist/Therapist/Psychologist – a practical psychologist, psychotherapist, psychiatrist or other specialist who has properly executed documents confirming their education (psychological, pedagogical, medical, etc.), work experience and qualifications, who provides information, assistance and knowledge in the field of practical psychology to an unlimited number of persons, as well as provides their services on the PsyHelp platform in accordance with this Agreement, which regulates the conditions for registering the Consultant and the possibility of access to the PsyHelp platform.
2.3. Consultation - one of the services offered on the PsyHelp platform. It involves the Client receiving a one-time online consultation or a multiple-session online consultation course in the field of practical psychology, personal development and other services from one or more specialists. Consultations by specialists presented on the Platform are conducted on terms that the Specialist and the Client agree upon directly through chosen communication services outside the Platform and outside the scope of this Agreement. The Platform Administration is not responsible for the quality of services provided by Specialists, as well as for the conscientious fulfillment of obligations by Clients.
2.4. Rules for providing services (hereinafter - the Agreement) are a Public Offer. The Agreement is considered concluded between PsyHelp and the User (Client or Specialist) from the moment the User accepts all terms of the Agreement. This Agreement regulates all aspects of service provision on the PsyHelp platform, defines the relationship between the Platform and Users when using the Platform and is the only official document regulating these relationships. All materials on the PsyHelp platform are for informational and reference purposes. Acceptance of these Rules (Acceptance) is mandatory for Users wishing to receive information or individual online consultations from specialists/practical psychologists in the field of psychology on the PsyHelp platform.
2.5. Acceptance - full, unconditional and unequivocal acceptance by the User of the terms of the Public Offer (Rules for providing relevant services) offered on the Platform.
2.6. If the user has registered/authorized on the website www.psyhelp.top or sent a callback request form, this indicates that the User agrees to the terms of the Agreement.
2.7. User - the word "Users" refers to an unlimited number of persons who have gone through the registration/authorization process on the website www.psyhelp.top (PsyHelp platform) as a Specialist, Client or Partner or have left their data when sending a callback request form, as well as when sending any other forms.
2.8 Content - all information on the website www.psyhelp.top including data, texts, images, video, audio, graphics, presentations, publications, articles, user content, messages and/or any other information.
2.9. User Content - all information published by Users of the PsyHelp platform. It includes, in particular, such types of user publications as:
a) Profile - the Specialist's description of the services they provide and methods of work, information about work experience and education, and other data;
b) Review of a Specialist or the PsyHelp platform;
c) Informational article
2.10. Partner (Referral) — a User registered on the PsyHelp online platform, having a referral link and participating in the distribution of advertising information about the Platform on the Internet and beyond.
2.11 Partner Program (Referral Program) - special conditions and software capabilities of the Platform that allow the Partner to receive commission rewards for participating in the advertising promotion of the Service. The terms of the Partner Program are described in the corresponding section of the Platform.
2.12. Personal Account - a section of the Platform accessible to authorized Users, designed to manage the User's personal data (Specialist / Partner / Client), such as login, password, contacts, personal information, billing. In the Personal Account, the User can use the presented functionality, including changing personal data, replenishing the balance, choosing suitable tariffs, ordering and paying for services, withdrawing funds, adjusting settings and more.
3. SUBJECT OF THE AGREEMENT (PUBLIC OFFER)
3.1. Procedure for receiving a Consultation by the Client:
3.1.1 The User (Client) selects a suitable Specialist to receive professional help and sends a request for feedback from the Specialist. The request can be sent by both authorized users and guests;
3.1.2 After submitting the form, the selected Specialist contacts the Client to agree on the terms of service provision. The Client and the Specialist agree on the conditions, time, place and cost of the Consultation directly through chosen communication services outside the Platform and outside the scope of this Agreement. The Platform Administration is not responsible for the quality of services provided by Specialists, as well as for the conscientious fulfillment of obligations by Clients. Online sessions and video conferences are not conducted on the PsyHelp platform.
3.2 Procedure for the Specialist's work with the Platform:
3.2.1. In order to start receiving requests from potential clients on the PsyHelp service, the Specialist needs to deposit an amount to their account on the PsyHelp Platform not less than the cost of one consultation set by the Specialist. Upon receiving a request, an amount equal to the cost of one consultation is deducted from the Specialist's personal account;
3.2.2. If for some reason the Specialist rejected the request and canceled the consultation with the Client, the funds deducted for the request are returned to the Specialist's personal account on the Service. The Specialist will be reimbursed for rejected requests within the established limit. If the acceptable number of rejected requests is exceeded, the Specialist's personal account is blocked by the administration to clarify the reasons for rejection;
3.2.3. The Specialist can both replenish the balance of the Personal Account and withdraw the unused budget balance through the payment systems available on the service.
3.3. Procedure for Partners' work with the Platform:
3.1.1. The PsyHelp online service provides a Partner Program for an unlimited number of individuals who are interested in mutually beneficial cooperation with the Platform (bloggers, webmasters, arbitrage specialists, etc.). For this purpose, Partners are provided with a referral link, which they can advertise in ways available to them and through which they can invite Users interested in Specialists' services to the Platform. Partners receive commission rewards according to the terms of the Partner Program for each request accepted by a Specialist.
4. SITE GUIDE
4.1. The conditions for registering a Specialist and the possibility of access to the PsyHelp platform are regulated by a special Agreement.
4.2. The website www.psyhelp.top (PsyHelp platform) DOES NOT provide and DOES NOT offer medical services or/and consultations in the field of medicine and related topics.
4.3. The information presented on the online platform www.psyhelp.top IS NOT medical advice of any kind. Nothing on the Website www.psyhelp.top can be construed as an attempt to offer or make a medical conclusion or otherwise engage in medical practice. All information on the site is presented for informational purposes only.
4.4. By accepting this Agreement, you also agree that you cannot use the PsyHelp platform to obtain prescriptions, any medical appointments for diagnosis, treatment, etc. Obtaining prescriptions, any medical appointments for diagnosis, treatment through or with the help of services provided by the Platform is strictly prohibited and is sufficient grounds for blocking and deleting your account.
4.5. The PsyHelp Platform is prohibited from being used to obtain medical assistance (including emergency).
4.6. The Platform does not recommend, refer to, support, evaluate or guarantee any advice, treatment information, links to medical institutions, products, procedures, doctors, consultants, coaches (trainers), psychotherapists, any other opinions or any other information provided by any consultant on the website www.psyhelp.top.
4.7. The User's (Client's) use of the Platform cannot be interpreted as approval, recommendation or guarantee by the platform of the services/information provided by any Specialist.
4.8. The administration of the PsyHelp service moderates all profiles added by Specialists, however, DOES NOT GUARANTEE and cannot guarantee the accuracy, completeness, safety, legality, quality of content or anything said, written by any specialist, including any information contained in the specialist's description.
4.9. The rating of psychologists on the Platform is compiled in accordance with criteria established by the Site Administration.
4.10. Services provided by specialists on the PsyHelp platform are rendered based on your voluntary personal request in oral or written form, including through the use of information and telecommunication technologies.
5. REGISTRATION AND ACCOUNT MANAGEMENT
5.1 To access advanced features of the Service and use its services, the User must create an account (Personal Account).
5.2. (Specialist, Client or Partner) is personally responsible for maintaining the confidentiality of account information, including login and password, as well as for all actions performed on behalf of this account.
5.3. In case of detection of unauthorized access to the account or other security issues, the user must immediately notify the Site Administration.
5.4. The User may face liability for damage caused to the Site or other Users as a result of unauthorized use of their account by third parties.
6. RESPONSIBILITY
6.1. The User bears full responsibility for any damage caused by intentional or careless actions that lead to a violation of the terms of this Agreement, or due to illegal access to personal information of other Users. Compensation for such damages is not provided by the Website Administration.
6.2. The Platform Administration is not responsible for:
- delays, failures, malfunctions in the operation of telecommunication, computer, electrical and other systems that occurred due to reasons beyond the control of the Platform Administration;
- actions and inaction of financial institutions, money transfer systems, as well as any delays arising in connection with their work;
- inability to access the Website if the User does not have the necessary equipment or technical means to use it;
- quality of services provided by Specialists;
- conscientiousness and timeliness of payment by Clients for Specialists' services;
- for any prescriptions, treatment information, diagnostics, treatment results and other information or services provided by Specialists;
- for the actions of any third parties.
